Natural Parents Do Not Have Priority in Future Custody ChangesShould the custodial parent die or become incapacitated, other Japanese family members generally are given custody of the child rather than the foreign biological parent. The Civil Code of Japan allows a custodial parent who wants to prevent the other natural parent of a child from gaining custody in the future, to independently approve adoption of the child by a new spouse or a relative. Contrary to Article 21 Paragraph (a) of the Convention on the Rights of the Child, this does not require the consent of the both natural parents. Solutions We Want To See
